Faridabad PLPA forest land: 5,938 homes remain in legal limbo—buyer checks

A Supreme Court-appointed committee’s interim report has left the status of 5,938 homes and dwelling units across 598 locations and 188.3 acres in four Faridabad villages unresolved. Buyers around Anangpur and the Aravalli belt must verify the exact khasra—not rely on a colony name or electricity connection.

The reported survey covers 5,938 homes across 188.3 acres

A report published on 4 October 2026 says the Supreme Court-appointed Central Empowered Committee is still examining how existing village habitation should be treated on Faridabad land covered by special orders under Section 4 of the Punjab Land Preservation Act. Its 18 September interim report reportedly records 5,938 homes and dwelling units at 598 locations spread over 188.3 acres in four villages. Of these, 5,771 are reported in Anangpur. The committee has not announced a blanket regularisation or demolition formula.

‘Unresolved’ does not mean that every structure has the same status

The reported count combines many locations, but legal risk attaches to the precise parcel, construction date, forest record, permissions and court directions. A house outside the land covered by a relevant Section 4 special order cannot be treated as identical to a structure inside it. Conversely, a municipal address, electricity bill, property-tax receipt, sale deed or long occupation does not by itself prove that non-forest construction was lawfully authorised on forest land.

What the Supreme Court decided about Section 4 land

In its 21 July 2022 judgment concerning Anangpur, Ankhir and Mewla Maharajpur, the Supreme Court held that land covered by the special orders issued under Section 4 of the PLPA has the characteristics of forest land for the purposes of Section 2 of the Forest (Conservation) Act, 1980. The Court said non-forest use after 25 October 1980 requires prior approval of the Central Government. It also directed action against remaining illegal structures erected after that date without such approval. That judgment—not a broker’s description of the neighbourhood—is the starting point for due diligence.

Why the committee is examining existing habitation separately

The current report indicates that the committee is consulting the Haryana government and the Union environment ministry before seeking further directions from the Supreme Court on village habitation. This is an evolving process. Until the Court issues a further order, a buyer should not assume that an occupied home will automatically be protected, regularised, demolished or compensated. Each statement must be tested against the exact khasra and applicable record.

Seven records to obtain before paying a token

Ask for the complete title chain and Jamabandi; the mutation history; the exact khasra and a certified demarcation plan; the applicable PLPA Section 4 order and forest-department map; any prior Central Government forest approval for non-forest use; the sanctioned colony or building plan and occupation status; and every notice, court order or pending case affecting the parcel. Have an independent property lawyer and a qualified survey professional match these records on the ground before signing an agreement.

Do not treat registry, tax or utilities as forest clearance

Registration records a transaction; mutation updates revenue entries; property tax assesses a municipal liability; and utility connections supply services. None of these documents substitutes for statutory forest approval. The PARIVESH forest-clearance portal contains project-specific proposals and decisions, but an approval for one road, institution or parcel cannot be extended to neighbouring land. Verify the proposal number, area, coordinates, conditions and final approval against the property being considered.

Extra checks for resale homes and plots near Anangpur

For an occupied resale home, obtain all notices served on the current and earlier owners, demolition or sealing proceedings, litigation papers and written opinions already obtained. For a vacant plot, do not pay a premium merely because construction exists nearby. Visit the revenue office and forest division with the parcel identity, compare the site against official maps and record any boundary discrepancy. Avoid cash components and clauses that shift unknown government action entirely to the buyer.

What Haryana Realty Hub will track

The next material event will be a final CEC recommendation or a further Supreme Court direction on existing habitation. Haryana Realty Hub will distinguish between the committee’s reported inventory, the 2022 legal rule and any later parcel or category-specific relief. Until then, the safest position is that the reported 5,938-unit inventory remains unresolved and requires property-level verification.
