Gurugram begins ₹446-crore RERA recovery from 71 developers: what buyers should do now

Gurugram authorities have ordered bank-account freezes and begun asset-attachment proceedings against 71 developers to enforce ₹446 crore in pending Haryana RERA penalties and refund certificates. The drive can improve recovery, but buyers still need to track their own order and execution record.

A district-level recovery drive has started in Gurugram

The Gurugram district administration launched a coercive recovery drive on 30 September 2026 to enforce pending monetary orders issued by Haryana RERA, Gurugram. According to reports by The Indian Express and Times of India, bank accounts linked to 71 developers have been ordered frozen against aggregate dues of ₹446 crore. Revenue officials have also started proceedings for attachment of movable and immovable assets. The reported action concerns unpaid penalties and refund certificates; it is an enforcement step, not a declaration that every project connected with a named group has the same legal status.

Seven reported balances account for most of the ₹446-crore total

The Indian Express reports large pending amounts against Ansal Housing and Ansal Construction Housing at ₹91 crore, Raheja Developers at ₹90 crore, Vatika Limited at ₹80 crore, Parsvnath Developers at ₹74 crore, Ramprastha Promoters at ₹57 crore, IREO at ₹24 crore and ILD Millennium at ₹8.59 crore. These are reported recovery balances in the administration's drive, not current prices, project valuations or fresh RERA penalties. Buyers should match the exact promoter legal entity, project phase and case number before drawing any conclusion about a specific property.

Why Section 40 matters to an allottee with a refund order

Section 40 of the Real Estate (Regulation and Development) Act, 2016 provides for recovery of interest, penalty or compensation imposed under the Act as arrears of land revenue when the liable promoter, allottee or real-estate agent does not pay. In practice, a favourable RERA order and an actual credit into the buyer's account are separate stages. The new Gurugram action is aimed at the second stage: turning outstanding recovery certificates into realised money through bank balances or attached assets.

An account freeze does not guarantee immediate payment

The administration's order can prevent dissipation of available money and create a direct route for recovery, but the recoverable balance depends on funds in the identified accounts, competing claims, asset ownership and the case-specific certificate. Reports say some recovery certificates have remained unpaid for more than four years. Authorities have warned that further measures, including civil arrest and detention under the applicable recovery process, may be considered if bank and asset recovery fails. Buyers should therefore treat the drive as meaningful progress, not as a promise of a fixed payment date.

What an affected buyer should keep ready

Keep a certified copy of the final RERA order, the recovery certificate, complaint and execution numbers, promoter's exact legal name, project and unit details, payment receipts, bank information and current contact details. Ask Haryana RERA or the concerned execution branch for the case-specific recovery status in writing and preserve every acknowledgement. If the order allows interest until payment, calculate it only according to the order's wording. Do not pay an unverified intermediary who promises priority recovery, and take case-specific advice before accepting a private settlement or signing a discharge.

Checks for someone considering a new Gurugram booking

Search the exact project phase and promoter on Haryana RERA's registered-project portal. Record whether the registration is live, lapsed, extended or superseded; open quarterly progress and monitoring records; and check the declared possession date, approvals, litigation and encumbrances. Then search the promoter and project in complaint and order records. A recovery proceeding against a company does not automatically cancel title or registration of every project, but it is a material risk signal that should be examined before paying a booking amount.

How Haryana Realty Hub will track this enforcement

The district administration has reportedly directed weekly progress reviews and time-bound action by revenue officers. Haryana Realty Hub will distinguish between notices, frozen accounts, attached assets and money actually disbursed to allottees as later records emerge. Buyers should rely on their own order and the live official record rather than social-media lists that combine different firms, projects or liabilities.
