Gurugram RERA sets aside Sector 106 plot cancellation and orders 10.8% delay interest

A Haryana RERA order has directed Chintels India to restore a 577-square-yard plot in International City-Plots—or provide an equivalent alternative—after buyers rejected a developer-initiated refund and chose to remain in the project.

The dispute concerned a transferred plot in Sector 106

The order concerns plot L-001 in Block L of International City-Plots, Sector 106, Gurugram. The 577-square-yard plot was originally allotted in May 2016 for more than ₹2.7 crore. Three purchasers acquired it from the original allottees through an agreement to sell dated 8 April 2022, and the developer recorded the transfer that month.

The buyers had paid approximately ₹1.3 crore

The purchasers had paid about ₹1.3 crore but did not receive possession. Chintels subsequently attempted to return that sum—first by cheque and then through RTGS. The buyers returned the money because they wanted the plot rather than an exit from the project.

RERA rejected the attempt to impose a refund

In its order dated 23 July 2026, Haryana RERA held that the decision to leave a delayed project or remain invested belongs to the allottee under Section 18(1) of the Real Estate (Regulation and Development) Act. The authority rejected the developer’s contention that an Enforcement Directorate land attachment and a court-ordered status quo justified cancellation of the allotment.

Reinstatement or an equivalent plot is due within 30 days

The authority set aside the cancellation and directed Chintels to reinstate the plot or allot another plot of the same size, location and price within 30 days. It also ordered delayed-possession interest at 10.8% per year from 17 February 2024.

Possession and conveyance remain linked to project approvals

The order further requires possession and execution of the conveyance deed within three months after the occupation certificate is obtained. The developer was restrained from charging holding charges or amounts outside the buyer agreement. Chintels told the newspaper that it would review the order after receiving it before deciding its next course.

What Sector 106 buyers should examine

Buyers considering International City-Plots should match the precise plot, block and project phase with the Haryana RERA record, sanctioned layout, title documents and any land attachment or court restriction. The reported order provides relief to the named complainants; other allottees should examine their own agreement, payment trail, possession date and project record before relying on the same reasoning.
